The short version: SunUp describes what crypto charts show – it never predicts prices, never gives financial advice, and never touches your money. You must be 18+, don't abuse the service, and remember that anything you do with your money is your decision.

These Terms of Service ("Terms") govern your use of the SunUp mobile app and related services ("SunUp", "the app", "we", "us"), operated by Symboyant Studios Pty Ltd (Australia). By creating an account or using the app, you agree to these Terms. If you don't agree, don't use the app.

You must be at least 18 years old to use SunUp. The app presents crypto market content and is not directed at children.

3. What SunUp does

SunUp reads the recent public market history of the coins on your watchlist once a day and describes what the charts show – trend, momentum, volatility, structure – in plain English ("readings" and "briefs"). It can also track levels associated with strong readings and notify you if a level is reached, and value a portfolio you enter manually. SunUp never connects to your money: no wallet connections, no exchange keys, and nothing is ever traded on your behalf.

5. Market data and accuracy

Prices and market history come from third-party data providers. Data can be delayed, incomplete, or occasionally wrong, and briefs can be late or unavailable when a provider or our service has an outage. To the extent permitted by law we don't warrant the accuracy, completeness, or timeliness of any market data, reading, portfolio valuation, or currency conversion shown in the app – verify anything that matters against your own sources before acting on it.

6. Your content

The watchlist, portfolio entries, and settings you create remain yours. You grant us a limited licence to store and process them only to operate the app for you (including generating your briefs and valuations). We don't sell your content or use it for advertising.

8. Service availability and changes

SunUp is provided on an ongoing best-effort basis; we may change, suspend, or discontinue features at any time, and features may differ between free and paid tiers. If paid subscriptions are offered, the terms shown at purchase (and the app store's own terms) apply alongside these Terms. We may update these Terms; material changes will be notified in-app or by email, and continued use after changes means you accept them.

9. Third-party services

SunUp relies on third parties to function, including Supabase (authentication, database, hosting), Expo (push notification delivery), and market-data providers. Their handling of data is described in our Privacy Policy. We're not responsible for third-party services we don't control.

10. Disclaimers

To the extent permitted by law, SunUp is provided "as is" and "as available", without warranties of any kind (including accuracy, fitness for a particular purpose, or uninterrupted or error-free operation). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, for loss of data, profits, or goodwill, or for trading or investment losses of any kind, arising from your use of (or inability to use) SunUp or reliance on anything shown in it. Where our liability cannot be excluded but can be limited, it is limited to (at our option) re-supplying the service or paying the cost of re-supply. Nothing here limits liability that cannot be limited by law.

12. Termination

You can stop using SunUp and delete your account and all your data at any time in the app (You → Delete my account and data). We may suspend or terminate your access if you breach these Terms or to protect the service or other users. On termination your right to use the app ends; provisions that by nature should survive (sections 4, 5, 10 and 11) survive.

13. Governing law

These Terms are governed by the laws of Australia (and the State or Territory of the operator's principal place of business), and you submit to the non-exclusive jurisdiction of its courts, without affecting any mandatory consumer-protection rights in your country of residence.
